General Terms and Conditions (General Terms) for All Organisers

Preamble:

The following General Terms and Conditions (General Terms) apply to contracts with you relating to the offers advertised and/or available for booking via this website from:

- Ratibor Theater e. V. (shows at the Ratibor Theater, Berlin)

- Gorilla Show GbR (shows at guest venues)

- Gorilla Theater e. V. (Impro School offers, including Impro in Therapy)

- Gorilla Gala GbR (business shows and training)

In addition, special contractual terms (Special Terms) apply to the specific offers of the respective entities named above. Together, these are also referred to as the Terms and Conditions. In the event of doubt, the Special Terms shall take precedence over the General Terms.

The General Terms and the Special Terms apply exclusively. Any differing or conflicting terms and conditions of third parties are hereby rejected. Any additions to our offers and Terms and Conditions must in all cases be made in text form.

General provisions / incorporation

The Special Terms and these General Terms can be accessed at https://www.die-gorillas.de/general-terms.html. The presentation of the respective offer and the ordering process indicate which Special Terms apply to your contractual relationship and which entity provides the requested service. The ordering process refers to the contractual terms incorporated into the contract. For online bookings, this information will also be summarised in a confirmation email.

The incorporated contractual terms may be downloaded during or at the end of the ordering process.

The contractual language is German. The German-language version of these Terms and Conditions is the sole legally binding version. Any English translation is provided for information and convenience only. Your order will be stored.

Subject matter of the contract / scope of services

The subject matter and scope of the respective contract (shows/training/workshops/seminars/courses/vouchers/etc.) are set out in the description of the relevant offer on this website, any offer document supplied to you in text form and/or the Special Terms.

Unless otherwise stated in the offer, the service relates to the content offered (courses/workshops/seminars/training, etc.) and not to delivery by any particular person.

Formation of the contract

The relevant offer will state the available booking options. The booking process is initiated either through the Billeto ticketing system or by your enquiry regarding the specific offer to the contact person indicated, usually by email (text form).

  1. Billeto booking process:

If this website redirects you to the Billeto ticketing system operated by Billeto GmbH, Richardplatz 1, 12055 Berlin, for your chosen offer, you complete the booking/order process in a manner binding upon you by entering the information requested, accepting the conditions communicated during the process and clicking the “Buy now” button. If you have provided your email address, you will receive an acknowledgement of receipt containing further information.

  1. Enquiries

We generally respond to direct enquiries (by email/telephone/post) with an offer in text form or by telephone. The offer contains the conditions for delivering the requested event, the prices/costs and any further necessary information. Offers are non-binding.

Once we receive your acceptance of the offer sent to you, we may confirm it within _3___ days (generally in text form or by telephone), thereby making the booking binding. In the absence of express confirmation, your order becomes binding upon full payment, unless we have previously withdrawn our offer or part-payment or instalment arrangements have been agreed. In the latter case, the order becomes binding once the first agreed instalment has been paid to us.

The stated prices apply. Unless stated otherwise, prices include VAT.

Existence or exclusion of a right of cancellation and model cancellation form

Exclusion of the right of cancellation for ticket purchases (shows) and bookings of Impro School courses, including Impro in Therapy offers

If you place orders via our website in the course of your trade, business or self-employed professional activity, you do not have a statutory right of cancellation, since this right is granted only to consumers pursuant to sections 312g and 355 of the German Civil Code (BGB).

Furthermore, pursuant to section 312g(2)(9) BGB, the right of cancellation is excluded for distance contracts concerning services related to leisure activities where the contract provides for a specific date or period of performance. You therefore have no right of cancellation in respect of orders/bookings made via our website where the service is to be provided on a specific date or during a specific period, irrespective of whether you act as a consumer.

Accordingly, no right of cancellation applies to the services currently offered through the ticketing system.

Right of cancellation

In cases other than those described in the preceding paragraphs, particularly when purchasing vouchers, you have the right of cancellation described below.

Cancellation policy

Right of cancellation

Where you place your order otherwise than in the course of your trade, business or self-employed professional activity, you have the right to cancel this contract for the purchase of vouchers within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you, or a third party nominated by you who is not the carrier, takes possession of the final item/voucher.

by means of an unambiguous statement (for example, by using the “Cancel contract” button on our website, by letter sent by post or by email) of your decision to cancel this contract.

You may use the attached model cancellation form, although this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Effects of cancellation

If you cancel this contract, we will reimburse all payments received from you, including delivery costs (except for any additional costs arising because you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event no later than fourteen days from the day on which we are informed of your decision to cancel this contract. We will make the reimbursement using the same means of payment as you used for the original transaction, unless expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen-day period has expired.

You bear the direct cost of returning the goods.

You are liable for any reduction in the value of the goods or for any voucher credit used only where that reduction results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

This means that we are not required to reimburse voucher amounts that you have already used or redeemed.

Vouchers

This website offers vouchers for Gorillas shows at the Ratibor Theater, issued by Ratibor Theater e.V., and vouchers for certain Impro School offers, issued by Gorilla Theater e.V. Details are provided in the relevant offers on the “Vouchers” subpage.

Vouchers for shows at the Ratibor Theater are sent by post within seven days of receipt of payment. No separate delivery charge is invoiced. The vouchers will therefore generally reach you within nine days. You may use the vouchers as a payment method in our ticketing system or redeem them at the box office, subject to availability. Vouchers must be presented when attending the theatre.

Impro School vouchers are value vouchers. They are available exclusively through our Billeto ticketing system by direct debit and for self-printing (print@home). Vouchers cannot be exchanged for cash.

Tickets / ticket delivery

Tickets are not generally sent out. Tickets reserved through the ticketing system must be collected from the box office in good time. Uncollected tickets expire. Tickets not collected on time may be released for sale at the box office. If you arrive before the event begins and your tickets have already been paid for, you are entitled to replacement tickets in the same price category. There is no entitlement to admission after the event has begun. If replacement tickets are unavailable, the admission price already paid will be refunded exclusively on site at the box office. If replacement tickets are unavailable for only some of the tickets you reserved, reimbursement is due only for those unavailable replacement tickets. Exceptions may be made as a gesture of goodwill.

As a general rule, admission tickets cannot be returned for a refund of the purchase price. Tickets may be placed on hold for later use or transferred to another event, subject to the prices applicable to the relevant events.

Liability

The statutory provisions apply unless the Special Terms for a particular offer provide otherwise.

Cancellation of an event

If an event, course, etc. is cancelled, we will offer alternative dates. If you are unable to attend any of the alternative dates offered, we will reimburse the fees charged. Please send a corresponding request to info@die-gorillas.de.

Special Contractual Terms (Special Terms)

Special Terms for Shows

Preamble

These Special Terms for Shows supplement the General Terms when tickets for Gorillas shows are purchased.

Where you purchase admission tickets for Gorillas shows at the Ratibor Theater through the Billeto ticketing system, directly at the theatre box office or by redeeming a voucher, the organiser of those shows and your contracting party is Ratibor Theater e.V., Cuvrystraße 20a, 10997 Berlin, ratibortheater@t-online.de.

For all other Gorillas shows at other stages or guest venues, particularly guest performances at Waschhaus in Potsdam, the organiser and contracting party for the ticket purchase is Gorilla Show GbR Berlin, Schudomastraße 42/44, 12055 Berlin.

These terms also apply to audience organisations and advance ticket agencies unless otherwise agreed.

Box office opening hours

The box office, which sells tickets only for the performance taking place that evening, generally opens 45 minutes before the performance begins. It remains closed on days without a performance.

Ticket sales – general provisions

Visitors are not permitted to offer tickets for sale on the organiser’s premises. Public or commercial resale of tickets is prohibited. This does not apply to purchasers whose business activities or articles of association include the resale or brokerage of tickets to members or other groups of persons and who have been authorised by the organiser for this purpose.

If an admission ticket is lost, a replacement ticket may be issued where the visitor proves or provides credible evidence of which ticket was purchased. The ticket price paid cannot be refunded.

Persons with severe disabilities who present an official disability card will be served with priority. A limited number of wheelchair spaces may be available, depending on the production. Companions officially recognised as necessary for a person with a severe disability (code “B” on the official German disability card) are admitted free of charge.

Additional conditions apply to group orders of 20 tickets or more (see Group Reservations).

Reservations

Reservations made in writing or by email will in all cases be confirmed by us in text form. Please always provide a current email address. Reserved tickets will be held at the box office and must be collected, and paid for where applicable, no later than 15 minutes before the officially stated start time. Once this deadline has passed, the tickets may be released for sale at the box office. At that point, the reservation and any entitlement to have the reserved seats held will lapse. Tickets already paid for are governed by the provisions on Tickets / Ticket Delivery in the General Terms.

Reservations that cannot be used should be cancelled as early as possible.

Where reservations are repeatedly not used, we reserve the right to accept future reservations from the persons concerned only against advance payment.

For tickets not purchased from the organiser, any claims must be directed exclusively against the institution or person from whom the tickets were purchased (advance ticket agency or audience organisation). No direct claims against us as organiser exist.

Group reservations (20 tickets or more)

Subject to capacity and demand, we offer advance reservations for groups of at least 20 people. Please submit these exclusively by email to our advance sales team at tickets@die-gorillas.de.

We will then send you an offer for your group order. You may accept it within 14 days by paying the stated advance sales price into the account specified in the offer. Receipt of payment by us is decisive.

If fewer than 14 days lie between our offer and the requested performance, the advance sales amount stated in our offer is due immediately. In this case, the payment period is reduced to the normal processing time for a standard bank transfer. Please contact us regarding any alternative arrangement. We will endeavour to accommodate your requirements.

After the payment deadline has expired, any late payment constitutes a new offer, which we may accept at our discretion. If capacity remains for the relevant performance, we will endeavour to fulfil your reservation request.

Subject to the conditions above, your group order is binding. If you wish to cancel your reservation at least 14 days before the booked performance, we will generally, as a gesture of goodwill, accept the return of up to ten reserved tickets and refund the advance sales price paid for them. If you wish to return no more than four individual tickets, we extend this goodwill period to 48 hours before the performance begins.

Cancellation or interruption

If a performance is cancelled or has to be stopped within the first two-thirds of its running time, a replacement performance may be offered or the admission price refunded. Travel costs and/or parking charges incurred will not be reimbursed. The same applies where, contrary to the published programme, a performance has to be changed at short notice, meaning on the day of the performance.

If a performance is stopped during its final third or the show is changed, there is no entitlement to a replacement performance or reimbursement of the admission price. If an event is rescheduled or cancelled, the visitor may choose either to attend an offered replacement event or to request reimbursement. Booking or handling fees will not be refunded.

The organiser reserves the right to make changes to the programme and cast without this giving rise to a right to return tickets already purchased. A change to the starting time likewise does not entitle the ticket holder to a refund.

Admission

Visitors holding valid tickets are generally admitted 45 minutes before the performance begins. After a performance has begun, and out of consideration for the performers and other visitors as well as for safety reasons, latecomers may be admitted only during a break suitable for the production. Latecomers are not entitled to the seat they purchased. Instructions given by front-of-house staff must be followed.

Cloakroom and lost property

  1. Coats and other outerwear may be taken into the auditorium only where this does not disturb other visitors. Items likely to cause disturbance are generally prohibited in the auditorium. Instructions given by front-of-house staff must be followed.
  2. Coats and other outerwear may be left in the cloakroom for the duration of the performance and are insured there in accordance with the displayed insurance conditions.
  3. Cloakroom items that have been exchanged, damaged or lost must be reported immediately to front-of-house staff.
  4. All found items must be handed to front-of-house staff. Lost property is dealt with in accordance with sections 978 et seq. BGB. The loss of any item must likewise be reported to front-of-house staff.

House rules, photography and recordings

  1. The organiser exercises its right to control access to and conduct within its premises, particularly the Ratibor Theater, through the theatre management. This authority may be delegated to employees or other third parties.
  2. Visitors may be refused entry or removed from the premises if their conduct disrupts the performance or other theatre operations, causes nuisance to other visitors, or if there are reasonable grounds to believe that they will do so to an unacceptable extent.
  3. Smoking is prohibited throughout the theatre building.
  4. Devices capable of disrupting the performance, such as mobile phones or electronic watches, must be switched off.
  5. Visitors may take photographs or make visual and/or audio recordings of any kind only by prior arrangement and with the express consent of front-of-house staff. Breaches may result in civil and criminal proceedings.
  6. Where authorised persons make visual and/or audio recordings during a public theatre performance, for example for radio or television, visitors agree by purchasing a ticket that they may be recorded in image and/or sound and that such recordings may be broadcast or published without entitlement to remuneration.

Special Terms for the Impro School

General provisions

The provisions in this section apply to all offers specified below.

Preamble

The following contractual terms supplement the General Terms for Impro School courses.

The Impro School offers both in-person and online courses. In addition to courses for beginners and advanced participants, it offers courses for actors. Its programme also includes the seminars, workshops and courses entitled “Impro in Therapy”, as well as summer academies, particularly the Trebnitz Summer Academy.

The organiser and your contracting party when booking courses is Gorilla Theater e.V., Schudomastr. 42/44, 12055 Berlin.

Allocation of places

Places on courses are allocated in the order in which bank transfers are received in our account. Your authorisation for collection by direct debit counts as receipt of payment at the time the workshop is booked.

Tutors

Where a workshop has several tutors, they will generally teach alternately unless stated otherwise.

If a tutor is unavailable, the session will be covered by a tutor with comparable qualifications.

Liability

We maintain public liability insurance covering property damage and personal injury for all our courses. Except in cases of gross negligence or intent, our liability is limited to the amount covered by that insurance.

Course language

Our courses and workshops are generally delivered in German. Any exceptions are stated in the relevant course offer.

IN-PERSON CLASSES

General provisions

The Impro School offers trial courses, courses for beginners, beginners/advanced participants and advanced participants, the Stage Class, Impro4ever and courses for actors. These are best booked through the Billeto ticketing system on our website. Details of the courses, prices and other conditions can also be found in the brief description of each offer.

Prepaid class pass for actors (drop-in courses)

The drop-in courses are offered exclusively to actors. Bookings are made using our class passes in the Billeto ticketing system. From the date of purchase, a class pass entitles you, for a period of 12 weeks, to attend eight courses of your choice from the range of Impro courses for actors (drop-in courses). Participation in each individual course is subject to prior registration.

Class passes for the drop-in courses (Impro for Actors) must be paid in full within four days of booking, allowing for the normal processing time of a bank transfer. Receipt of payment by us is decisive. Otherwise, the booking will lapse.

The 12-week redemption period referred to in paragraph 1 begins with the next available Impro course for actors after we have received payment and ends on the final day of the week in which the period expires.

Payment terms

You may pay by direct debit or bank transfer.

The payment terms stated under the preceding heading apply to class passes for the drop-in courses for actors (Impro for Actors).

In all other cases, where payment is made by direct debit, the course fee will be collected from your account either in two instalments or in full at the stated times. If you prefer to pay by bank transfer, you may pay the full amount at once or in two instalments: 40 per cent as a deposit and 60 per cent no later than 14 days before the course begins. If the course begins within 19 days, payment of the full course fee by direct debit is the only available option.

Cancellation terms

Class passes for the drop-in courses (Impro for Actors) may be cancelled in full up to 24 hours before the first course session, exclusively by email or letter.

The following terms apply to all other courses: if you cancel up to four weeks before the course begins, the course fee will be refunded in full (100 per cent). If you cancel between four weeks and 14 days before the course begins, 60 per cent will be refunded. After that, the course fee will not be refunded unless a person on the waiting list takes your place. The required minimum number of participants is seven. If this minimum is not reached ten days before the course begins, we will agree alternatives with you or, regrettably, cancel the course with a full money-back guarantee.

Venue

Our usual venues are the Europäisches Theaterinstitut ETI (Rungestraße 20, 10179 Berlin) and the Ratibor Theater (Cuvrystr. 20a, 10997 Berlin). Details and any changes of venue are stated in the relevant course offer.

INTERACTIVE ONLINE CLASSES

Time of payment

For direct debit payments, the course fee will be collected from your account at the time stated in the information email. Otherwise, you determine the time of payment by making a bank transfer.

Cancellation terms

If you cancel up to four weeks before the course begins, the course fee will be refunded in full (100 per cent). If you cancel between four weeks and 14 days before the course begins, 60 per cent will be refunded. After that, the course fee will not be refunded unless a person on the waiting list takes your place. Courses take place with a minimum of six and a maximum of eight participants. If the required minimum is not reached two days before the course begins, we will agree alternatives with you or, regrettably, cancel the course with a full money-back guarantee.

Venue / Zoom

All courses take place online via Zoom, operated by ZOOM Video Communications, Inc., 55 Almaden Boulevard, 6th Floor, San Jose, CA 95113. You will receive the access link by email no later than one day before the course begins. The access link is personalised and must not be shared with third parties. Using Zoom entails the processing of your personal data. This processing is carried out exclusively by Zoom itself, including where Zoom acts as a processor within the meaning of Article 28 GDPR. You are responsible for meeting the technical requirements for participation via Zoom.

Making any audio and/or visual recording of the event, by any means, is prohibited.

IMPRO IN THERAPY

Seminar fees

Seminar fees do not include accommodation or meals.

For the Applied Improvisation in Therapy continuing education programme, Basic Courses 1–3, the total cost stated on the website for the current courses applies when all three modules are booked together. Booking modules individually may result in a higher total cost. Current module fees are stated on our website.

Module 1 may be booked separately.

Modules 2 and 3 may be booked only together and require prior participation in Module 1.

Successful completion of Basic Courses 1–3 and issue of the DGAIT certificate incur an additional fee, as stated on our website.

Payment terms: payment is made by direct debit or bank transfer. On registration, 60 per cent of the total amount is payable. The remaining 40 per cent must have reached our account no later than seven weeks before the course begins; otherwise participation is not possible.

For participation in Module 1 only, the full amount is payable immediately upon registration.

Cancellation terms

Participants may withdraw from the contract in writing up to eight weeks before the continuing education programme begins. An administration fee of €50 will be retained for every cancellation. If cancellation occurs up to six weeks before the course begins, 40 per cent of the total amount plus the €50 administration fee will be retained. For later withdrawal, the full participation fee is payable unless a person on the waiting list is available to take the place. In that case, the organiser will charge only the stated administration fee of €50.

The required minimum number of participants is six per module. If this minimum is not reached two weeks before the course begins, we will regrettably have to cancel the course and will refund the seminar fee paid in full.

Non-attendance / inability to attend

There is no entitlement to reimbursement of seminar fees for parts of the seminar not attended. Nor is there any entitlement to make up missed hours. As a gesture of goodwill, and subject to available capacity, the organiser may permit a participant to make up a module.

Certificate of attendance / certification

At the end of the continuing education programme, participants receive a certificate of attendance stating the course content taught. Participants seeking a formal qualification in the form of a final certificate as part of a multi-part continuing education programme must complete the entire curriculum and provide all evidence specified in the relevant course announcement, such as project documentation.

Other provisions

Participation may not be transferred to another person.

Participant documents and all other teaching materials, such as worksheets, are protected by copyright and intended for personal use only. They may be reproduced, passed to other persons or used in the participant’s own teaching only where the source is clearly identified, for example: training script Fabian / Klehr, Die Gorillas Berlin, year. The concept for the continuing education series is the property of Regina Fabian and Barbara Klehr.

TREBNITZ SUMMER ACADEMIES

Minimum enrolment

Courses take place with a minimum of eight and a maximum of twelve participants. If the required minimum has not been reached 75 days before the course begins, we will agree alternatives with you or, regrettably, cancel the course with a full money-back guarantee.

Payment terms

The course fee is collected from your account in two instalments: 70 per cent upon booking and the balance no later than 45 days before the course begins. Current fees are stated on the website.

Cancellation terms

If you have to cancel at short notice, the place will first be offered to persons on the waiting list. If nobody is found to take your place, we will reimburse the costs proportionately as follows:

If you cancel at least 75 days in advance, we will refund in full the deposit collected up to that point (70 per cent).

If you cancel fewer than 75 days in advance, we will not refund the 70 per cent deposit, but we will not collect the second instalment of 30 per cent.

From 45 days before the course begins, no refund will be made unless a person on the waiting list takes your place.

Venue

The course begins and ends at the stated times in Trebnitz. Participants are responsible for arranging their own travel to and from the venue.
